This
End-User License Agreement (EULA) is a legal agreement between you and
CASHOPOS, which includes computer software and may include associated media,
printed materials, and “online” or electronic documentation (“Software
Product”). By installing, copying, or otherwise using the Software Product, you
agree to be bounded by the terms of this EULA. If you do not agree to the terms
of this EULA, do not install or use the Software Product.
DISTRIBUTION
The Software
Product is being distributed as Freeware for both personal and commercial use.
It may be included with CD-ROM/DVD-ROM distributions. You are NOT allowed to
make a charge for distributing this Software (either for profit or merely to
recover your media and distribution costs) whether as a stand-alone product, or
as part of a compilation or anthology, nor to use it for supporting your
business or customers. It may be distributed freely on any website or through
any other distribution mechanism, as long as no part of it is changed in any
way. You may permanently transfer all of your rights under this EULA, provided
the recipient agrees to the terms of this EULA.
USER AGREEMENT
Installation
and Use You may install and use an unlimited number of copies of the Software
Product. Use Restrictions You may reproduce and distribute an unlimited number
of copies of the Software Product; provided that each copy shall be a true and
complete copy, including all copyright and trademark notices, and shall be
accompanied by a copy of this EULA. Copies of the Software Product may be
distributed as a standalone product or included with your own product as long
as the Software Product is not sold or included in a product or package that
intends to receive benefits through the inclusion of the Software Product. The
Software Product may be included in any free or non-profit packages or
products.
Copyright Restriction
You may not
reverse engineer, decompile, or disassemble the Software Product, except and
only to the extent that such activity is expressly permitted by applicable law
notwithstanding this limitation. All title and copyrights in and to the
Software Product (including but not limited to any images, photographs,
clipart, libraries, and examples incorporated into the Software Product), the
accompanying printed materials, and any copies of the Software Product are
owned by the Author of this Software. The Software Product is protected by
copyright laws and international treaty provisions. Therefore, you must treat
the Software Product like any other copyrighted material. The licensed users or
licensed company can use all functions, examples, templates, libraries and
symbols in the Software Product to create new setup packages and distribute
them.

are not responsible for problems such as data loss on your computer.

can contact our company by email with screenshots of errors. There is no
charges
for this, and the company is not responsible
for any losses caused by this.

are not responsible for any problems that occur with your computer. Any loss of
data
or software is your own responsibility. We have
nothing to do with it.
Limitation of Responsibility
In no event
shall the author of this Software be liable for any special, consequential,
incidental or indirect damages whatsoever (including, without limitation,
damages for loss of business profits, business interruption, loss of business
information, or any other pecuniary loss) arising out of the use of or
inability to use this product, even if the Author of this Software is aware of
the possibility of such damages and known defects.
Right to Reject
While we
thrive to enhance our relationship with the customers, clients, associates,
partners, suppliers, we have the right to reject the service at any time during
and or after providing service to not to continue any relationship and or not
to continue with the recurring services.
Service Performance
While we
generalise the time it takes to complete a service, often times depends on
government entities in providing approval, acceptance, response, and or
completion of intermediary steps in completing the service we render to you. It
is imperative that you assume such delays during the service execution.
Generally,
we will not be responsible to the customers in any way for the inconvenience
caused when the time given to complete the service exceeds the limit. It is
normal for labor shortages or workers' health problems and many other complex
problems to occur while providing the service.
Termination
Without
prejudice to any other rights, the Author of this Software may terminate this
EULA if you fail to comply with the terms and conditions of this EULA. In such
event, you must destroy all copies of the Software Product and all of its
component parts.
Jurisdiction
This Agreement shall be governed by laws of India. Any disputes or differences
arising out of or in relation to this Agreement shall be submitted to exclusive
jurisdiction of courts at Erode, TamilNadu, India. In addition to the
foregoing, any disputes arising under this Policy shall be governed by the laws
of India.
Pricing
While
pricing of our product / services vary from time to time, typical price range
of our single unit (subscription) services are from FREE to Rs.26,500. et times
may cross beyond this threshold.
Re-Pricing
may be needed for the service taken by you due to the complexity in providing
such and or is identified as a different service based on the documents provided
and or understood by the requirement. Such price difference would be requested
to be paid to continue to render the services.
Free Trials
provided part of the marketing effort, and business operations where applicable
are to provide a way to try, test, set the expectations with the potential
client but not for their business use. The data (fair-use policy applicable) in
the trial period possibly erased without any communication if no immediate
subscription.
Free
Subscription on the other hand is for the client to use the software,
functionality for their business use during the duration of such subscription.
Free Support
where applicable goes with a reasonable expectation, and fair use policy with
respective to the price paid for the original / parent service where the free
support or support service was added.
Guarantees
100%
Satisfaction Guaranteed refers to certain services provided by CashoPOS where
mentioned such guarantee specifically, would allow the paid user to get refund
of the fees paid to the Company when the written request made with in 30 days
from the date of initial payment for the relevant service.
Check the
operations section of this agreement on the timing and amount of refund
possible.
If you are
dissatisfied with the Services prior to completing the billing steps within the
program, your exclusive remedy is to immediately discontinue using the
Services.
If you (paid
user) completed the Company Service fee / payment after calling in to our
support center and your return was rejected by the ITD (or Other Tax
Authorities such as GSTN / CBDT / CBIC for GST related filings) and you cannot
re-file, it is your responsibility to contact Company's Customer Service
Department by email at CashoPOS @gmail.com within 20 days of the original
billing date with the proof of payment for the services to request a refund of
the fees paid to the company.
Providing
consent to eFile (Online, email confirmation for Services) and / or using
services more than 30 days from the date of initial subscription means you are
satisfied with Company Services. Guarantee do not apply to bulk, affiliate,
institutional, intermediary service providers, or those who go through partner
access or partnership programs where the company rendered to their clients.
While CashoPOS customer service try to record your grievance, and help you in
general, no refund is possible in such circumstances.
Retention of information
We retain
your personal information for as long as it is required for the purposes stated
in this Privacy Policy. Sometimes, we may retain your information for longer
periods as permitted or required by law, such as to maintain suppression lists,
prevent abuse, if required in connection with a legal claim or proceeding, to
enforce our agreements, for tax, accounting, or to comply with other legal
obligations. When we no longer have a legitimate need to process your
information, we will delete or anonymize your information from our active
databases. We will also securely store the information and isolate it from
further processing on backup discs until deletion is possible.
Information we collect

information: We might collect your Name, E-mail ID, Mobile Number, Phone
Number, Street, City, State, PIN Code, Country data for providing better
services for you. This information collecting after user acceptance.
Payment and
billing information: We never collect your billing name, billing address and
payment method when you pay for any service on our website. We NEVER collect
your credit card number or credit card expiry date or other details pertaining
to your credit card on our website.
Business
information: We collect information of your business, and your client business
information, if you are using our Online Accounting Software / Services, this
is only for you to run your business, while we may communicate with you for any
software, and other compliance related matters.
Information
you post: We never collect information you post in a public space on our
website or on a third-party social media site
Other
Information: If you use our website, we may collect information about your IP
address and the browser you're using. We might look at what site you came from,
duration of time spent on our website, pages accessed or what site you visit
when you leave us. We might also collect the type of mobile device you are
using, or the version of the operating system your computer or device is
running.

Operations
If you are
dissatisfied with the Services prior to completing the billing steps within the
program, your exclusive remedy is to immediately discontinue using the
Services.
if there is
an eligible service fee refund against certain services, it must requested with
in the 30 days from the payment date in an email to cashoPOS@gmail.com. No
service fee refunds are possible after 35 days from the date of payment under
any circumstances due to due to operational / technical reasons with the
payment gateways.
if eligible,
service fee refunds are capped at 80% of the total fee paid due to operational
and service reasons.
No future
service fee credits are allowed due to operational reasons, hence if a
refundable service fee is identified such can be applied aginst a future
service but such a new service can be allowed to be taken if the service can be
served with in 90 days of the original payment.
If you have
taken a service / plan accidentally, and needs a conversion of such service /
plan to another service / plan, a small conversion fee wil be levied to track
such event. Typically this is a fee up to Rs. 150.
DISCLAIMER OF WARRANTY
The Author
of this Software expressly disclaims any warranty for the Software Product. The
Software Product and any related documentation is provided “as is” without
warranty of any kind, either express or implied, including, without limitation,
the implied warranties or merchantability, fitness for a particular purpose, or
noninfringement. The entire risk arising out of use or performance of the
Software Product remains with you.
Limited Warranty for Company
Products and Services
While we
spend a lot of time, energy in making sure our software runs optimally and
provide 100% accurate income tax returns, TDS preparation, GST returns, GST
ready Accounting, Tax Saving investment products / services, you are required
to review the same for ensuring it's correctness. We are not responsible for
any issue that arises from incorrectness and any damages that caused to you.
This
agreement will be immediately terminated from your side if any unauthorized
activities ( without any refund. If we detected any illegal activities or
verbal abuse. )
When Uninstall
Please note that when you remove the software from your computer, all data you have saved so far will be lost. It is not possible to restore it later. If you have any backups on another device, you can restore them from there.
Note : The base folder C:/POS_INS never deleted. The user can delete it manually.
Software Update of Re-uninstall
Please note
that you will be reinstalling the software to upgrade but all previous data
will erased.
